Terms of Service

1. Acceptance of Terms

By accessing or using EnhanSell ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by Lemnoria OÜ, a private limited company registered in Estonia, EU.

1a. Eligibility

The Service is intended for commercial use by individuals aged 18 or older. By using the Service you represent that you are at least 18 years old and are using the Service for business or professional purposes. If you do not meet these requirements, do not use the Service.

2. Description of Service

EnhanSell provides AI-powered product photo enhancement and marketplace listing generation tools for e-commerce sellers. Features are subject to change at any time.

3. Accounts

You are responsible for maintaining the security of your account credentials. You must notify us immediately at •••@••• if you suspect unauthorised access. We are not liable for losses arising from your failure to protect your credentials.

4. Subscriptions and Billing

Subscription plans are billed monthly in advance. Your subscription renews automatically at the end of each billing period unless cancelled before the renewal date. You may cancel at any time via Account Settings; cancellation takes effect at the end of the current billing period. All purchases are final — see our Refund & Credit Policy.

5. Credits

Credits are consumed when you use AI features. Two types of credits exist:

• Subscription credits — included with your monthly plan. Available for the duration of the active billing period and forfeited when the subscription ends or is cancelled.
• Top-Up credits — purchased separately. Do not expire and persist regardless of subscription status.

Credits are non-transferable, have no cash value, and are not refundable except for automatic refunds on failed AI jobs as described in our Refund & Credit Policy.

6. Acceptable Use

You may not use the Service to upload illegal, infringing, defamatory, or harmful content. You may not use the Service to generate spam, manipulative listings, or content that violates marketplace platform rules. We reserve the right to suspend or terminate accounts that violate this policy without prior notice. For full details, see our Acceptable Use Policy.

7. Intellectual Property

You retain ownership of images you upload. By using the Service, you grant us a limited licence to process your images solely for the purpose of providing the requested AI enhancement or listing generation. You represent that you have the necessary rights to the images you upload.

AI-generated output (enhanced images and listing text) produced from your inputs is assigned to you to the extent permitted by applicable law. Be aware that AI-generated content may not qualify for copyright protection in all jurisdictions, as many legal systems require a human author. You are responsible for verifying the copyright status of AI outputs in your territory before relying on them commercially.

8. AI Output Disclaimer

AI-generated enhancements and listings are provided "as is". You are responsible for reviewing AI output before publishing on any marketplace. Lemnoria OÜ does not guarantee accuracy, compliance with marketplace rules, or fitness for a particular purpose of any AI-generated content. Your images are sent to third-party AI providers (fal.ai, OpenAI) for processing; see our Privacy Policy for details.

9. Account Termination

You may delete your account at any time via Account Settings. We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to other users or the Service. Upon termination, your access to the Service ceases and any remaining credits are forfeited.

10. Limitation of Liability

The Service is provided "as is". To the maximum extent permitted by applicable law, Lemnoria OÜ shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount paid by you in the three months preceding the claim.

11. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Estonia and the applicable laws of the European Union. Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Tallinn, Estonia, without prejudice to mandatory consumer protection rights under the laws of your country of residence. EU consumers may also use the EU Online Dispute Resolution platform.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the new Terms.
